Our inspector visited the property in question to inspect the damage that was caused by the fallen tree. A photo of the tree on the pool cover was provided by the insured. Our inspector made the following observations:

  • The decking was cracked and chipped (13 feet).
  • The coping was cracked (10-12 feet).
  • The pool cover was a Coverlon cover.
  • There were 4 tears in 3 panels in the cover.
  • The vinyl liner was torn at the bead, where the tree hit.

It was plainly clear to our inspector that the damage was caused by the impact of the tree falling on the pool and cover. This was corroborated by a photograph provided by the insured that showed the tree trunk on the cover of the pool. The damage was consistent with the picture in terms of where the damage was located on the pool and pool cover. Because the damage was caused by the fallen tree, the homeowners held no responsibility for the damage, and had no part in causing the damage.
