Swimming Pool Expert Witnesses

What is a Pool Expert Witness?

You may be asking yourself, what even is an expert witness? Generally, an expert witness is someone who — based on their education, training, certification, or experience — is considered to be a credible source by the judge who’s handling a particular court case.

Expert witnesses are often utilized as subject matter experts who can offer an objective point of view on a particular subject. This is why expert witnesses are industry-specific.

In the pool industry, for example, an expert witness may be a pool contractor — someone who’s spent a lot of their life building pools. But it also could be an engineer or even an electrician.

It really depends on the claim. Our network of expert witnesses can provide information related to claims for above-ground pools, in-ground pools and public pools.

If a particular insurance claim has to do with the structural integrity of a pool, the court may require an expert witness with some sort of structural engineering degree or even have a lot of experience working as a structural engineer in the field. Again, it varies by claim.

When Are Swimming Pool Expert Witnesses Needed?

An expert witness for pools is commonly required when there’s a legal dispute involving liability. It could be a dispute between two individuals, an individual and a company — a hotel with a public pool, for example — or two companies. If one party believes the other is at fault, they may decide to seek some sort of compensation. But if both parties cannot come to an agreement, the dispute may end up in court, where a judge will determine who owes who what.

While in court, a discrepancy between the two parties may surface, at which point the best solution is to call in a swimming pool expert witness who can objectively speak on the matter.

Some examples of when a swimming pool and spa expert witness is needed include:

  • An individual or company, like a hotel or a gym, building a pool claims a contractor is at fault for issues with the pool’s construction and would like to seek compensation.
  • An individual who is injured at a pool believes the owner of the pool is at fault and would like to seek compensation — there’s already a law, the Virginia Graeme Baker Pool and Spa Safety Act, related to a horrible drain incident that happened in 2002,
  • An individual’s or company’s pool experiences property damage from extenuating circumstances — weather, for example — and files an insurance claim, but the insurance company claims it’s not responsible for the damage and disputes the claim.

These are just a few situations that may require an expert witness for swimming pools, but there are many other circumstances where an expert witness could be used to help settle a dispute
